PLEASE READ THIS RELEASE AND WAIVER CAREFULLY BEFORE YOU SIGN IT. BY SIGNING THIS RELEASE AND WAIVER YOU WILL BE WAIVING LEGAL RIGHTS.

In consideration for participating in the 2025 Bounce UP ATL Pickleball Tournament (hereinafter referred to as the "Event"), sponsored by the TRAE YOUNG FAMILY FOUNDATION and TRAE YOUNG and each of his and their respective employees, managers, owners, operators, and affiliated companies and organizations (hereinafter referred to as the “Young Parties”), I agree as follows:

1. I EXPRESSLY AND VOLUNTARILY ASSUME THE RISK OF DEATH, ILLNESS OR OTHER PERSONAL INJURY SUSTAINED BY REASON OF PARTICIPATING IN THE EVENT, WHETHER OR NOT CAUSED BY THE NEGLIGENCE OR OTHER FAULT OF YOUNG OR ANY OTHER PERSON. I acknowledge that I am not required to participate in the Event and that my participation is voluntary and solely for my enjoyment. I understand and acknowledge that my participation in the Event may require me to engage in physical activity that may be strenuous and/or potentially dangerous, including as a result of factors such as the weather and extreme heat.

2. I AGREE TO INDEMNIFY, EXCULPATE, RELEASE, FOREVER DISCHARGE AND HOLD HARMLESS, THE YOUNG PARTIES from all actions, claims, demands, damages, and liability of any nature whatsoever (including attorneys’ fees) (hereinafter referred to as "Claims") which I may have by reason of my participation in the Event or the risks assumed by me hereunder.

3. I COVENANT NOT TO SUE OR MAKE A CLAIM against the Young Parties for damages or other losses sustained as a result of my participation in the Event.

4. I UNDERSTAND THAT BY SIGNING THIS RELEASE I AM GIVING UP MY LEGAL RIGHT TO SUE AND/OR TO SEEK COMPENSATION FOR ANY INJURIES AND/OR DAMAGES THAT I MAY INCUR AS A RESULT OF THE NEGLIGENCE OF THE YOUNG PARTIES, MY PARTICIPATION IN THE EVENT, AND/OR ANY RISKS ASSUMED HEREUNDER.

5. I understand that I may be videotaped, photographed and/or recorded at the Event. I hereby grant permission and authorize the Young Parties and their affiliates to videotape, photograph and/or record me, my voice and/or my property during my participation in or attendance at the Event (hereinafter collectively known as “Image”). I hereby grant to the Young Parties and their affiliates an irrevocable, nonexclusive, royalty-free, sublicensable, perpetual license to use, display, publish, post, reproduce and allow others to use, display, publish, post, and/or reproduce the Image, in whole or in part, individually or in conjunction with other images, printed or electronic matter, in any media now or hereafter known, for educational, promotional, or marketing purposes or any other legitimate purpose whatsoever, and to use my name in connection therewith.

6. By signing below, I represent that I am over 18 years of age OR I am the legal guardian of a Minor that is a participant in the Event, and I am competent to contract in my own name (or on behalf of the named Minor), have the right to enter into this Release on behalf of myself and/or that I am the parent or legal guardian of Minor and I am duly authorized to execute this Release on his/her behalf.
